Banking and Capital Market Criminal Law
Proceedings in the area of banking and capital market criminal law require a basic understanding of the financial markets. Anyone who does not understand the regulatory peculiarities as well as the factual peculiarities and the functioning of banks, stock exchange and financial market will hardly be able to succeed here.
Our lawyers do not only publish scientifically on this challenging subject matter, in particular on the Banking Act (KWG), but did also provide advice and act as counsel for the defense in various banking proceedings, for instance in the proceedings concerning SachsenLB, Bankhaus Sal Oppenheim, several private banks in the area of so-called cum/ex proceedings as well as in numerous proceedings involving various savings banks, in all kinds of constellations. In the area of the capital market, lawyers of the firm contended successfully, inter alia, for the landmark decision of the Federal Supreme Court (BGH) on the determination of damages in case of the distribution of shares (BGH decision of 25 July 2018 – 2 StR 353/16).
